Before you can apply for certain non-immigrant (H, L, O, or P) visas at a U.S. embassy or consulate, however, a visa petition must be filed with and approved by the USCIS. Other nonimmigrant visas, such as E or R visas (please refer to The Basics), do not require the initial filing of a visa petition to the USCIS.

Once your visa petition with the USCIS is approved, or if you are applying for a visa that does not require the initial filing of a visa petition to the USCIS, you should visit the Department of State forms website.
